Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and the operator of CheckCardValue (“CheckCardValue”, “we”, “us”) governing your use of https://checkcardvalue.com, its card identification, price lookup and collection features (the “Service”). By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

IMPORTANT: SECTION 17 CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT HOW DISPUTES ARE RESOLVED.

1. Eligibility and age

• You must be at least 13 years old to use the Service. If you are under 13, do not use the Service or give us any information. The Service is not directed to children under 13.
• If you are at least 13 but under 18 (or under the age of majority where you live), you may use the Service only with the involvement and permission of a parent or legal guardian, who agrees to these Terms on your behalf.
• You must be at least 18 years old (or the age of majority where you live) to buy a paid plan and must be able to form a binding contract. A parent or guardian may buy a plan for a teen's use and is responsible for that use.

2. What the Service is — and isn't

CheckCardValue lets you photograph or upload a picture of a trading card, uses automated artificial-intelligence models to read the card, matches that reading against our card catalog, and shows estimated market values for the matched card. It also offers free card and set pages, rankings, guides, a collection tracker and spreadsheet export. We may change, suspend or discontinue any part of the Service at any time.

• Not a marketplace. We do not buy, sell, hold, grade, authenticate or appraise cards, and we are not a party to any transaction between you and anyone else.
• Not an offer. A value shown on the Service is not an offer by us or anyone to buy or sell a card at that price.
• Not financial or investment advice. Cards are collectibles, not investments we recommend. Nothing on the Service is financial, investment, tax or legal advice, and no professional relationship is created.
• Not a grading or authentication service. Condition guesses and identification are automated and may be wrong. We do not verify that a card is genuine.

3. Prices, data sources and identification accuracy

Estimated market values from recent sales data. Not an offer to buy, and not financial advice.

Card data and price data come from third-party sources, including the pokemontcg.io API, which republishes market prices from TCGplayer (US) and Cardmarket (Europe). We update prices periodically (normally once a day) and build our own price history from those updates. When our catalog cannot answer, we may show an “AI estimate from web sources”, generated by an AI model that searches public web listings; such estimates are labeled, show their sources and can be less reliable than synced prices.

Values are estimates. They can be out of date, incomplete or wrong, and the price you can actually get for a card depends on its exact condition, grading, variant, demand, fees and the selling channel. AI identification can pick the wrong card, set or variant. Always check the result before relying on it, and check current listings and sold prices before you buy or sell. You are solely responsible for decisions you make using the Service.

4. Trademarks and affiliation

CheckCardValue is not affiliated with, endorsed by, or sponsored by Nintendo, The Pokémon Company, Creatures, GAME FREAK, Wizards of the Coast, PSA, or TCGplayer. Pokémon and all related names are trademarks of their respective owners. Card images © their respective owners.

We refer to card names, set names, characters and brands only to identify the cards they describe (nominative use). Card images are displayed for identification and reference and remain the property of their owners. If you believe content on the Service infringes your rights, see our DMCA / Copyright Policy.

5. Accounts

Saving cards to a collection, exporting and paid plans require an account. Give us an accurate email address, keep your password confidential, and tell us at [email protected] if you suspect unauthorized access. You're responsible for activity under your account. You can delete your account at any time from the account page, which also deletes your collection.

6. Free use

Card pages, set pages, rankings and manual catalog search are free. Each visitor may make one free photo scan in total (not per day), counted across the browser, account and network (IP address) used; signing up or creating another account does not grant additional free scans. A scan that fails or finds no match is not counted. We may change or withdraw the free allowance at any time.

7. Subscriptions, automatic renewal and cancellation

We currently offer these plans (prices in US dollars, before any applicable tax):

• Weekly: US$3.99/week, billed every week, including 300 photo scans per week.
• Monthly: US$7.99/month, billed every month, including 1,000 photo scans per month.
• Yearly: US$49.00/year, billed every year, including 1,000 photo scans per month.

• Paid plans are sold through Polar Software, Inc. (“Polar”), which acts as our merchant of record: Polar is the seller of record, processes your payment, and calculates, collects and remits sales tax and VAT where applicable. Polar's own buyer terms also apply to your purchase.
• Plans automatically renew at the end of each billing period (weekly, monthly or yearly, as selected) and you will be charged the then-current price using your saved payment method until you cancel.
• You can cancel at any time, online, with “Manage billing” on your account page (or the Polar customer portal linked in your receipt email), or by emailing [email protected]. Cancellation stops future renewals; you keep access until the end of the period already paid for.
• Each plan includes a number of photo scans per period, as described on the pricing page. Yearly plans receive their allowance each calendar month. Unused scans do not roll over and have no cash value. A scan that fails or finds no match does not use your allowance.
• We may change prices for future billing periods. We will give you at least 30 days' notice by email before a price increase takes effect, and you can cancel before it applies.
• Refunds are governed by our Refund Policy.

8. Plans are personal

A plan belongs to the account that bought it and is for your personal use. Accounts may not be resold, published or shared. We may suspend accounts used in violation of these Terms.

9. Your content

You keep all rights to photos you upload and to your collection data (“Your Content”). You grant us a limited, worldwide, royalty-free license to host, store, transmit and process Your Content solely to provide the Service to you — for example, to send a photo to our AI provider for identification, to keep signed-in scan photos for up to 30 days, and to store your collection until you delete it — and to use de-identified scan results (what was read, which card matched, and any correction you made) to measure and improve identification accuracy. You represent that you have the rights needed to upload Your Content. Please photograph only the card; avoid capturing people, documents or other personal information in the picture.

10. Acceptable use

You agree not to:

• upload anything unlawful, infringing, sexually explicit, or containing malware, or photos of people without their consent;
• use the Service to misrepresent a card's identity, condition or value to someone else, to sell counterfeit cards, or to commit fraud;
• circumvent usage limits, rate limits, bot checks or bans (for example by rotating IP addresses, clearing cookies or automating accounts);
• scrape, crawl or bulk-download the Service's pages, prices or images, reverse engineer it, overload it, or interfere with it;
• use the Service or its data to build a competing product or dataset;
• resell or provide the Service to third parties without our written permission.

We may log usage, rate-limit, suspend or block access (including by IP address) to enforce these rules.

11. Our content

The site, software, design, compiled price history, rankings, guides and export formats are owned by us or our licensors and protected by law. Except for your own exports of your own collection, you may not copy, republish or redistribute them without permission.

12. Advertising, affiliate links and third-party services

Free users see ads served by Google AdSense. Some links to retailers and marketplaces, such as TCGplayer (through the Impact affiliate network) and eBay (through the eBay Partner Network), are affiliate links: if you buy after clicking one, we may earn a commission at no extra cost to you. Affiliate relationships do not change the prices we show. See our affiliate disclosure.

The Service relies on third parties, including OpenAI for AI processing, pokemontcg.io for card and price data, Polar for payments, Cloudflare for delivery, storage and bot protection (Turnstile), and Google for advertising. Third-party sites and services are governed by their own terms, and we are not responsible for them or for transactions you make on them.

13. Disclaimer of warranties

The Service, all card identifications, prices, values, estimates and other output are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, timeliness, non-infringement, and uninterrupted or error-free operation.

14. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, trading losses, lost value of any card or collection, lost data or business opportunities, arising from or related to the Service or any output, even if advised of the possibility. Our total liability for any claim is limited to the greater of (a) the amounts you paid us in the 12 months before the claim or (b) US$50.

Some jurisdictions don't allow certain limitations, so some of the above may not apply to you.

15. Indemnification

You will defend, indemnify and hold us harmless from any claims, losses and expenses (including reasonable attorneys' fees) arising from Your Content, your use of output (including any purchase or sale you make), or your breach of these Terms or the law.

16. Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time if you breach these Terms or create risk or legal exposure for us. Sections 2–4, 9, 11 and 13–19 survive termination.

17. Dispute resolution — arbitration and class action waiver

Before filing a claim, you agree to contact us at [email protected] and try to resolve the dispute informally for 30 days. If it isn't resolved, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration may be conducted online or by phone.

You and we each waive the right to a jury trial and to participate in a class action, class arbitration or representative proceeding. You may opt out of this arbitration agreement by emailing [email protected] within 30 days of first accepting these Terms with your name and a statement that you opt out.

18. Governing law

These Terms are governed by the laws of the State of Delaware, USA, and the Federal Arbitration Act, without regard to conflict-of-law rules. Nothing in these Terms limits mandatory consumer protections of the place where you live.

19. General

These Terms, with the Privacy Policy and Refund Policy, are the entire agreement between you and us about the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger or sale. We may update these Terms; material changes will be posted here with a new effective date, and continued use after that date means you accept them.
